‘700 District Judges Pretending That They’re President’: Newt Gingrich Says Judicial Activists Threaten US Survival

The former House Newt Ginrich speaker appeared on Fox Business on Tuesday, sharing concerns about power brought to the US district judges.

District judges have used national injunctions to halt President Donald Trump’s policies across the United States. When appearing in “Kudrow,” Ginrich warns in the current situation, and in his view, 700 district judges behave as if they had presidential power, interfering with the detailed aspects of the presidency, threatening the governance of the country.

“You can’t have 700 district judges pretending to be president. You can’t have a judge who decides that every detail of the presidency will somehow ruin it. That makes it impossible for the United States to survive as a nation,” Ginrich said.

Gingrich said the founding father’s concerns about judicial hegemony reflect today’s concerns about over-acquisition of judges.

“Jefferson said anyone who thinks he can have a judicial advantage would be an oli-head, that would end the possibility that people would decide,” Ginrich told host Larry Kudrow when the host told the founder feared judicial dictatorship. “And the second request in the American Revolution after no unrepresentation taxation was to rule the judges because they were the king’s judges. They were imposing things on people. They didn’t represent the people.”

Based on historical examples, Ginrich mentioned Abraham Lincoln’s strong opposition to judicial hegemony.

“The fact is when Lincoln strongly opposed the sense of judicial hegemony, by the government of the people, by the people, and for the people. [Roger B.] Taney, who just introduced him, gave a stern lecture that the Supreme Court went too far and it was wrong,” Ginrich said.

“There’s a long tradition here, but in the late 1950s it really breaks down with this crazy idea that lawyers and judges are better than others of us.

When President Trump took office on January 20th, he quickly enacted several executive orders to limit illegal immigration, It has been declared Mexican drug cartels, TDA, and MS-13, as foreign terrorist organizations. Democracies and unions repeatedly challenge Trump administration policies by filing lawsuits, resulting in several judges who issue national injunctions delaying these measures. In response, Republican lawmakers are now proposing new laws that will limit district judges from imposing national injunctions on certain enforcement actions.
