Mexican national was declared dead while in U.S. Border Patrol custody

San Luis Rio Colorado, SonoraA Mexican man was released after being declared brain dead while in U.S. Border Patrol custody in April and died in Yuma days later.

U.S. Customs and Border Protection said staff at the Yuma Regional Medical Center declared the man brain dead on April 4, the day after he encountered border agents at Yuma Station near San Luis.

Border Patrol exercised “prosecutorial discretion” and released the man from custody on April 5, CBP said.

The man was confirmed dead two days later.

Hospital staff found cocaine in the man’s system, according to CBP.

Yuma Border Patrol agents first spotted the man lying under bushes about 100 yards north of the border wall near San Luis Rio Colorado on April 3.

The man was found near Avenue 1E, approximately 4.5 miles southeast of the intersection of Highway 195 and South Avenue B.

The man helped me to his feet after the agent told him to get up. According to CBP, there were no apparent physical injuries at this point, and the man was awake and coherent.

The man said he didn’t feel well, and when he was taken into custody and inside the agent’s Border Patrol vehicle, he sought medical help.

The agent called for emergency medical services and was met by an ambulance at the intersection of South Avenue B and Highway 195. EMS then transported the man to Yuma Regional Medical Center for further treatment.

Agents tracked the ambulance and established a lookout for the hospital.

The man was declared brain dead at 1:33 pm on April 4th and pronounced dead three days later at 2:28 pm on April 7th.

The incident is under investigation by the Yuma County Coroner’s Office and CBP’s Office of Professional Responsibility. The Office of the Inspector General of Homeland Security was also notified.
