A Maricopa County grand jury ruled against indicting a Phoenix police officer, who the county attorney alleged used excessive force while detaining a man in October.

The Maricopa County Attorney’s Office determined that Officer Eddie Becerra’s actions on October 27 merited criminal charges.

A video shows two Phoenix police officers punching and kicking the suspect, who police say shot the officer’s patrol car. The incident occurred at a convenience store near 59th Street and Buckeye Road.

According to the county attorney’s office, prosecutors introduced the case to a Maricopa County grand jury on Jan. 26, which included body-worn camera footage, surveillance footage provided by the convenience store where the incident occurred, and bystander witnesses. It also included footage recorded by a person.

A grand jury declined to indict.

The MCAO also considered the facts and evidence regarding another police officer, Nicholas Beck, but determined that there was no reasonable likelihood of him being convicted of his actions, and sought a grand jury indictment. I didn’t.

The Phoenix Law Enforcement Association issued a statement from President Darrell Kliplin regarding the decision, praising the decision.

“The evidence provided by body cameras and surveillance footage is clear. The suspect approached a marked patrol car and opened fire at point-blank range, attempting to kill two Phoenix police officers before the area was occupied. I fled on a quick trip I was in,” he said in a statement. “The officers were able to arrest the suspect after acting swiftly and decisively to prevent him from harming them or any of the guests within QuickTrip.
