Disney Attempts To Evade Wrongful Death Lawsuit In The Most Shocking Way

Disney has asked a Florida court to dismiss a wrongful death lawsuit after a woman suffered a fatal allergic reaction at a Disney Springs restaurant.

Dr. Kanokpong Tansuan dined at the Raglan Road Irish Pub on October 3, 2023, and informed the waiter that he had severe allergies to nuts and dairy products. Dr. Tansuan requested an “allergy-free meal” and questioned the waiter about items listed on the menu, the report said. News 12 Long IslandAccording to court documents, Dr. Tan Xuan died later that night from “anaphylaxis caused by elevated levels of dairy and nuts in his body.” According to News 12 Long Island, Disney is seeking to have the lawsuit dismissed because Dr. Tan Xuan's husband signed up for a one-month trial of its Disney+ streaming service, which requires users to arbitrate all disputes with the company.

Tang Xuan's husband, Jeffrey Piccolo, has sued Disney, but Disney claims that provisions in the Disney+ contract he signed several years ago make the lawsuit impossible.

According to the outlet, court documents state that the waiter asked the chef “if certain dishes could be made allergen-free,” before returning and telling Tang Xuan that it was possible.

According to News 12 Long Island, the lawsuit alleges that Tang Xuan and Piccolo repeatedly questioned the waiter to make sure the food contained no allergens before ordering fritters, scallops and onion rings.

They claim that when the meal arrived at their table, it did not bear an “allergen-free” label, and they asked the waiter again if the meal was completely free of nuts and dairy.

At that point, the waiter reportedly “assured” that this was the case.

At around 8pm, Tang Xuan and Piccolo's mother decided to go shopping separately after dinner, and Piccolo returned to his room with the leftovers.

Upon entering Planet Hollywood, Tang Xuan began having difficulty breathing and eventually collapsed to the floor.

She administered an EpiPen to herself when she began to have an allergic reaction, according to the lawsuit.

The lawsuit further states that Thanh Xuan's mother-in-law called multiple times to see her, but to no avail. When she returned to the hotel and called again, someone answered the phone and informed her that Thanh Xuan had been rushed to the hospital, according to News 12. According to News 12, the lawsuit alleges that Raglan Road “failed to educate, train or instruct employees to ensure food was allergen-free.”
