The Daily Caller's investigative team traveled from city to city to talk to homeowners who have fallen victim to squatters. Sometimes, opportunists prey on the kindness or incompetence of homeowners. We spoke with a New York City woman who lost her home after squatters took advantage of her elderly mother's good intentions.
Professional squatters seek out vacant properties to claim them for themselves. As one Los Angeles homeowner learned the hard way, even a short vacation can cost you your dream home. Even mansions in Beverly Hills can fall into the hands of squatters.
The timeline looks like this:
Day 1
If you find someone in your home, call the police. If there is no evidence of a break-in and the occupant asserts squatter's rights, there is nothing the police can do. This becomes a civil matter and expensive proceedings must be initiated in court.
So you hire an eviction lawyer and then all you have to do is wait.
Day 45
This is probably the earliest a court date can be set, as your attorney will need to serve the complaint and file notices on everyone in the house, which takes time.
The best case scenario is that the squatters don’t show up in court, after which you can begin eviction 30-45 days later, but you’ll have to keep their belongings for another six months.
But what's more likely is that they will show up and prolong the process in order to remain in “their home” for as long as possible.
After 365 days
If they show up, a lengthy litigation process begins. There will be delays. There will be rescheduling. There will be appeals. The squatter can even file for bankruptcy, which will automatically stay any judicial proceedings until the bankruptcy is resolved.
During that time, you're still responsible for the normal maintenance of the property, just as you would be if you had tenants who pay rent. You can't turn off the water or heat. You can't change the locks. If you do, you could be fined or even arrested.
We spoke with one New York City landlord who was dragged out of his home in handcuffs after a squatter called the police on him for trying to change the locks.
By the time it's all over, you may be tens of thousands of dollars in debt and your property may be completely destroyed.
It's no wonder that landlords are sometimes willing to bribe squatters up to $100,000 to get them to leave, but more often than not, it's ordinary people who can barely afford to pay their bills who end up becoming victims.
Liberals would like you to think that squatters' rights protect ordinary people who just need a few more weeks to make their rent, but the truth is that squatters' rights strengthen an entire small-scale industry of crime.
Professional squatters use fake leases to turn good properties into trap homes. In many cases, they resort to violence to keep owners away from “their” property. And because of a bloated and backlogged court system, eviction orders take years to be adjudicated, let alone enforced. From the smallest apartment to the largest mansion, no one is spared.
