Elite University Says Race ‘Neutral’ Policies ‘Constitutes Discrimination’

Columbia University's latest discrimination guidelines state that campus policies that are “neutral” and don't take race into account are “discriminatory.”

University Updated The university released its “Student Anti-Discrimination and Discriminatory Harassment Policies and Procedures” on Monday, writing that policies that have a “disproportionate and unjustifiable adverse impact” on “neutral” and “protected” classes are discriminatory. The policy defines discrimination as “treating individuals differently” based on a protected class “without a legitimate, non-discriminatory reason.”

“It is discrimination to treat an individual less favorably because of their actual or perceived membership or affiliation to a protected class, or when a neutral policy or practice has a disproportionate and unjustified adverse effect on an individual because of their actual or perceived membership or affiliation to a protected class more than on another protected class,” the policy states.

In Colombia, “protected” classes include characteristics such as age, citizenship, race, nationality and religion, according to the website.

The Supreme Court ruled in 2023 that race-based admissions policies are unconstitutional, with Justice Clarence Thomas upholding a “color-blind Constitution.” (The group that asked the Supreme Court to strike down affirmative action said it was “deeply concerned” that elite universities were not complying with the ruling.)

“The elimination of racial discrimination means the elimination of all racial discrimination,” the ruling read. “Thus, the Court ruled that the Equal Protection Clause applies 'without regard to differences of race, color, or national origin.' It states: [its] application.' … '[t]”The guarantee of equal protection cannot have one meaning when applied to one individual and another when applied to persons of different skin color.”

Columbia University has come under criticism in recent months for its response to pro-Palestinian protests that disrupted the campus during the spring semester.
