Left Wing DA Declined To Charge Sex Offender Who Exposed Himself To Children In Women’s Locker Room

Steve Descano, a lawyer with the Commonwealth of Fairfax County, allegedly refused to prosecute registered sex offenders because the male transgender identity and county policy protected him from fraud.

Richard Cox was arrested in Arlington County in December 2024. Several parents allegedly exposed the man to a young girl in the girls’ locker room at Arlington Aquatic Center, which shares the facility with Washington Liberty High School. The man claiming to be a transgender woman is said to have exposed herself to several locations across Arlington and Fairfax counties over the course of several months, but was not charged by Descano due to the county’s policies allowing the use of facilities based on gender identity. Because of this policy, Descano discovered that no crime was committed by Cox.

Descano reportedly refused to indict Cox a few months before June 2024 after being exposed to the women’s locker room at Planet Fitness in Fairfax County.

Fairfax County Speaker Jeff McKay declined to question reporters Tuesday whether the county would change its policies protecting criminals.

Arlington Public Schools (APS) in January doubled its policy allowing men to enter women’s toilets and locker rooms if they assert their transgender identity after Cox’s December arrest, and instead confirmed the district’s commitment to “comprehensive” facilities. Several Virginia residents spoke at an Arlington School Board meeting in early February, asking the district to overlook sex offender cases and maintain policies to protect sex offenders.

The APS will confirm with ABC 7 News that visitors to the school are not listed on the sex offender register and that Cox is no longer permitted by Fairfax County Recreation Centers.

The Descano office did not immediately respond to a request for comment from the Daily Caller News Foundation.
