Washington DC – Today, America First Legal (AFL) filed an amended lawsuit against all 15 Arizona counties (Apache, Cochise, Coconino, Gila, Graham, Greenlee, La Paz, Maricopa, Mohave, Navajo, Pima, Pinal, Santa Cruz, Yavapai and Yuma) for failing to take steps to remove foreign nationals from their voter rolls.
On July 16, AFL sent letters on behalf of its clients to election officials in all 15 Arizona counties, demanding that they fulfill their legal obligations to block foreigners from voting, and threatening that AFL would take legal action on its clients' behalf if they failed to do so.
On August 5, 2024, the AFL announced that it would establish a partnership with the Arizona Strong Communities Foundation (A.K.A. translationand Yvonne Cahill, a registered voter and naturalized citizen, filed suit in Arizona for brazenly refusing to follow the law. The lawsuit's claims were based on an Arizona law that requires county recorders to perform monthly maintenance of voter rolls to remove aliens from the voter rolls. Nevertheless, Maricopa County removed the case to federal court, arguing that the case also involved federal law, which in the County's view should be interpreted in federal court. Maricopa County is notorious for using procedural maneuvers to delay election litigation and prevent substantive hearings. However, Maricopa County's attempt backfired. Arizona court rules allow only one county to be sued in such a lawsuit, while federal court rules allow a plaintiff to sue multiple counties at once.
Now that AFL's clients have filed suit in federal court, AFL has added 14 other Arizona counties to the suit. every Counties in the state are obligated to fulfill their statutory obligations.
Two federal laws that have been in place for nearly three decades, 8 USC § 1373(c) and 8 USC § 1644, allow state and local authorities to obtain information about an individual's citizenship or immigration status for any lawful purpose. Yet an Arizona county decided to ignore these tools and threaten the integrity of the 2024 presidential election by failing to remove foreign nationals from its voter rolls.
