A judge has dismissed Abe Hamade’s retrial challenging the outcome of the state’s attorney general election, which saw Republicans lose to Democrat Chris Mays in one of the tightest elections in state history.
Mojave County Superior Court Judge Lee F. Jansen, who dismissed Hamade’s challenge in December after a three-hour trial, said in Friday’s ruling that his decision to deny a retrial was a “close election.” It was a close call at the time,” he said. . “
Jantzen, however, did not provide an explanation for the verdict, instead writing that it was delayed by “a fire at the courthouse over the weekend and several emergencies.” He wrote that by noon on July 17, he expects to have a full “discussion of this ruling and response to other arguments” regarding the case.
Hamade’s lawyers argued in May for a new trial in Mojave County Superior Court, where changes to voter registration records prevented more than 1,100 people from voting and then-Secretary of State Katie Hobbs (now Arizona Governor). ) claimed to have suppressed the vote. During the race-mandated recount.
The recount reduced the number of votes cast between Mays and Hamade from 511 to 280 out of 2.5 million votes cast in statewide elections. But as Mays City attorneys and the office of the secretary of state in Maricopa County said in May, Mr. Hamade’s side had failed to prove that the allegations would affect the outcome of the election.
“This fight is not over,” Hamade campaign spokesman Erica Knight said in a statement. “We are taking this historic legal battle to the Arizona Supreme Court…when all is said and done, we will win on the merits and restore confidence in our electoral system. “
Mays said she was “satisfied” with the verdict.
“As we have said all along, this is a baseless lawsuit and plaintiffs have not submitted any factual evidence,” she said in a written statement. “We are pleased to see the judge’s ruling denying the request for retrial. The will of the Arizona voters will not be compromised.”
