Brit Hume Explains Why Supreme Court ‘Went As Far As It Could’ Regarding Alleged MS-13 Member In El Salvador

Brithume placed emphasis on Fox News on Monday on a Supreme Court decision that includes a deported man who is allegedly a member of the MS-13 gang.

The Supreme Court has ordered the Trump administration to work back to MS-13 member Kilmar Armando Abrego Garcia’s allegations despite jurisdiction restrictions and lower court deadlines. When appearing in “Special Report with Bret Baier,” Hume explained why he thought the Supreme Court had done “as much as possible” to return him.

“It’s a bit of a gray area, Brett. The Supreme Court ruling said the administration should promote his return, [but it] I didn’t say it [it] Hume told Beyer.

Hume said the distinction points to the limitations of the Supreme Court’s authority, particularly on foreign policy and international relations.

“There is obvious reason for that. The principle is that he is currently in detention of another government in El Salvador, a sovereign country he is a citizen, and the jurisdiction of the Supreme Court does not apply there,” Hume said. “So it’s all we can do is instruct the administration to try and bring him back, but we can’t go any further because we deal with foreign policy issues and diplomatic relations here.

President Salvadora’s visit to the White House on the same day raised doubts as to whether the Trump administration made a formal request for the release of the man. Hume said the Salvadora leaders have made it clear that they have no intention of releasing individuals. “Now at this hearing, the administration has actually formally requested that El Salvador bring this man back to this country, or at least he should take him away from El Salvador. I don’t know what the answer will be, but the president of El Salvador said he’s pretty strong in the Oval office, saying it’s an addition to El Salvador. “So this may have been turned out to be mistakenly done by this administration by sending him there, but I’ve admitted, but it may now be out of the reach of the court.”

The Trump administration argues that it is not obligated to return suspected MS-13 member Abrego Garcia after his deportation to El Salvador. In the court’s application, the Justice Department said the federal courts have no authority to interfere in foreign policy decisions, particularly regarding Garcia’s repatriation and detention at the mega prison in El Salvador.

Immigration and customs enforcement arrested Garcia in March and deported him to El Salvador, where authorities put him in the country’s mega prison for gang members. Garcia, who illegally entered the United States in 2011, was first flagged as an associate for the MS-13 after arrests in Maryland in 2019 and tips from informants.
