Attorneys for Northern Arizona Health Care, City of Flagstaff, and Flagstaff Community First appeared Thursday in Coconino County Superior Court for a just cause order hearing on Proposition 480. NAH said the referendum that voters signed to put Proposition 480 on the ballot said, “This site will be used for the construction of retail and commercial spaces and no medical facilities are scheduled to be constructed.” Flagstaff Community First says it took the ordinance passed by Flagstaff City Council verbatim, but the petition makes no mention of future hospital projects. Judge Brent Harris asks Arellano if there will be a hearing if he puts the hospital on the petition. “If they had added the word ‘hospital’ and omitted or removed the wording about retail, we wouldn’t be here today,” said Arellano. Flagstaff Community First attorney Jacqueline Mendez Soto disagreed with Arellano’s reasoning, stating, “As long as the key clauses are explained or summarized in their summary, that is sufficient and all There is no need to explain the terms of the Judge Harris told the court that he would issue an opinion on the matter by 1:30 p.m. Friday.
