Marc Elias, a former lawyer for the Clinton campaign and a Democratic National Committee (DNC) representative focused on election integrity, sent a letter to the administration of Virginia's Republican governor, Glenn Youngkin, on Monday threatening a lawsuit if independent candidate Cornel West remains on the ballot in November's election.
The letter, first obtained by The Daily Caller, calls on Virginia State Board of Elections Chairman O'Bannon, Virginia State Board of Elections Commissioner Susan J. Beals, Virginia Secretary of State Lynn McDermid and members of the Board of Elections to “immediately” remove O'Bannon from the state's electoral rolls.
“We, on behalf of Clear Choice Action, are writing this letter regarding the last-minute decision by the Department of Elections and the Board of Elections (collectively, the “Department of Elections”) to run Dr. Cornel West as Virginia's presidential candidate in the November 5, 2024 general election. The Department of Elections violated the law in running Dr. West and must immediately reverse its decision,” the letter alleges.
West was disqualified from voting, and his campaign sent a formal request to the Election Commission asking for reconsideration. The Election Commission reconsidered and reversed its previous decision. letter Opposition to West's campaign has been mounting, and now Elias' law firm is threatening to sue in an effort to keep West off the ballot.
He is running as an independent in the 2024 presidential election and has been an outspoken critic of both Harris and Trump. Other candidates on the ballot include former President Donald Trump, Vice President Kamala Harris, Libertarian Party candidate Chase Oliver, independent candidate Claudia de la Cruz and Green Party candidate Jill Stein of Virginia.
“If the Department refuses to take the requested action, we reserve the right to pursue all legal remedies against the Department, including lawsuits seeking injunctions and enforcement orders to compel compliance with the law,” the letter continues.
