EXCLUSIVE: Rep. Clyde Reintroduces Legislation To Stop Federal Government From Working With Big Tech On Censorship

Georgia Republican Rep. Andrew Clyde on Wednesday reintroduced a bill that would ban the federal government from using big tech companies to infringe on Americans' First Amendment rights.

The Daily Caller obtained a first copy of the bill, which Clyde first introduced in December 2022. The Supreme Court ruled in favor of the Biden administration on Wednesday morning over its alleged collaboration with social media companies.

The bill is titled the “Defense of Free Speech Act.” report This shows that the Biden administration is using the Department of Homeland Security's (DHS) Cybersecurity and Infrastructure Security Agency to pressure social media companies to police Americans' online speech.

According to Clyde's office, the bill would:

  • It would prohibit the federal government from directing, encouraging, or compelling social media companies to ban users from their platforms, label content as misleading, unreliable, true, or false, or share users' data without a warrant.
  • Disband the Disinformation Control Commission and prohibit federal funding for the creation of such commissions in the future.
  • Strengthens anti-deficiency laws by prohibiting federal employees from soliciting or accepting free services, such as free advertising.
  • If Americans can prove they have been censored, deplatformed, or labeled, these actions violate the Free Speech Defense Act, allowing them to take enforcement action against the government in federal court.
  • Requires the Attorney General, in consultation with the Assistant Attorney General for Civil Rights, to report annually to Congress on the federal government's compliance with the provisions of the law.

“The federal government is attempting to circumvent the Constitution and silence the American people by using social media companies as private agents to carry out its bidding,” Clyde told the Caller before reintroducing the bill. “Furthermore, these egregious censorship efforts are being weaponized to interfere in our elections. Given the dire consequences the left's suppression of the Hunter Biden laptop article has had on our elections, Congress must act swiftly to rid our country of this unconstitutional muzzling before the 2024 elections. It is urgent that we move forward with my Free Speech Defense Act, which will finally eliminate proxy government censorship and protect both Americans' free speech and our free elections,” he continued.
