EXCLUSIVE: Sen. Cotton Goes After Recruiting Firms After Reports Accuse Them Of Excluding ‘Non-Diverse’ Candidates

Sen. Tom Cotton, R-Arkansas, on Thursday responded to reports that recruitment agencies were colluding with companies to eliminate “non-diverse” candidates from the hiring pool. Letters were sent to 10 referral companies regarding their diversity hiring practices.

We obtained a letter addressed to 10 recruitment agencies in the Cified Search Group. In his letter, Cotton urges companies to reject any requests for racial discrimination in hiring practices.

“Compliance with DEI mandates may violate federal law. For example, Title VII of the Civil Rights Act prohibits private employers from making employment decisions based on race. United States Equal Employment Opportunity Commissioners of the “EEOC'' have warned that “diversity programs pose legal and real risks to companies,'' Cotton wrote in the letter.

“Employment policies based on race are being challenged in court, and there is no doubt that DEI efforts by companies that discriminate on the basis of race will suffer the same fate as affirmative action in academia. In June, the Supreme Court ruled in two cases to block affirmative action, and many U.S. companies stopped using diversity, equity, and inclusion (DEI) language in the workplace.
