‘False Paradigm Of Independence’: Gregg Jarrett Explains How Presidential Oversight Of DOJ Is Grounded In Constitution

Gregg Jarrett, a legal analyst at Fox News, told Fox Business Friday that the presidential oversight for the Department of Justice is based on the US Constitution.

A judge appointed by former President Joe Biden has thwarted President Donald Trump’s agenda by temporarily suspending the Department of Education’s move to cancel a $600 million grant aimed at supporting diversity, equity and inclusion in teacher training programs. When he appeared in “The Evening Edit,” Jarrett said he would expose the widespread mythology that the Justice Department must operate independently of the president’s influence, which was widely promoted by the media and academia. He said this belief is unfounded in the constitution.

“There’s this perpetual myth that is being propagated by the media by the media that the Department of Justice is operating independently. That is, the president must always hand it over. It’s fiction,” Jarrett said. “We can’t see anywhere in the Constitution. Certainly the opposite applies. Under Article 2, the administrative body is single. The President is the sole head of all agencies and departments, which includes the Department of Justice.”

Jarrett said the misconception did not prevent him from claiming the false paradigm of independence that is actively sold to the public by several media figures and liberal scholars. Jarrett added that such stories ignore the explicit constitutional authority given to the president.

“He hires, fires and directs what they’re doing. The DOJ is less independent than the Commercial Transactions, the Treasury, or HHS, or any other department, but that doesn’t stop media illiterate or liberal scholars from trying to sell this fiction to the public, claiming that it is not the case. This false paradigm of independence,” Jarrett said. “It is true that there are legal constraints. The DOJ must respect legitimate processes, equal rights and the Bill of Rights, but also be aware of the direction and leadership of the President, which is also bound by the Constitution.”

“When Jamie Ruskin says that this is the end of the world, he doesn’t pay attention to the man. He wouldn’t know what the constitution means if the constitution slaps him over his head,” Jarrett said.

The Democratic National Committee and other education groups, together with the teachers’ unions, face some legal challenges for the Trump administration. These groups are united in opposition to government cuts to DEI (diversity, equity, inclusion), and encourage schools to resist those directives that are deemed unnecessary.
