A federal judge in Nashville denied the government’s allegation detaining Kilmer Abrego Garcia, an immigrant living in Maryland.
The federal prosecutors immediately filed a notice that they intend to appeal the decision. Both the decision and notice of appeal by US Magistrate Judge Barbara Holmes were filed Sunday.
By denying the government’s allegations to detain Abrego, Holmes acknowledged that if he is released he would likely be immediately detained by US immigration and customs enforcement. Previously referred to as “Abrego Garcia” in the government’s legal application, Abrego notified the court as the last name he made in “Abrego.”

Nevertheless, Holmes wrote: “A legitimate process requires that all accused of a federal crime be given a presumption of innocence unless proven guilty beyond reasonable doubt, and that the deprivation of individual liberty before trial can occur only in carefully limited circumstances with all procedural safeguards obtained by the Bale Reform Act.” ”
“Abrego, like all arrested in federal criminal charges, is entitled to a full and fair decision on whether he must hold trial and remain in federal custody. The court will give Abrego the due process he has been guaranteed.”
The judge set a date for the court on June 25th to confirm the terms of Abrego’s release.
Abrego took him to Nashville from El Salvador on June 6th and faced human smuggling fees related to the 2022 Tennessee traffic stop. He was pulled for speeding with nine Hispanic men behind the Chevrolet suburbs. He was not arrested or charged in the case.
However, a recent Homeland Security investigation opened at a three-year-old stop, bringing up the charges he is currently facing.
Abrego appeared in federal court on June 13th and entered a plea of ”not guilty” to the charges.
Prosecutors argued that Abrego should be detained because his crimes have mild casualties. He is a flight risk and could threaten witnesses. Abrego has not been charged with a crime related to a child victim.
Holmes dismissed federal prosecutors’ argument that Abrego allegedly lacked clear evidence to pay for the illegal transport of immigrants from Texas to domestic destinations.
