A California man, who was initially arrested over Memorial Day weekend on a DUI felony, was released from custody.
Troy A. Ayers, 38, of Marieta, was arrested at a location on Beachcomber Boulevard on May 28 after police said he collided with another vehicle while driving drunk. Ayers was arrested for felony charges in the case, but the Mojave County Attorney’s Office ultimately declined to press charges against Ayers instead of further investigation on May 30 to determine his possible intoxication. He declined to press charges against Ayers pending the results of his blood tests.
The Lake Havasu Police Department was mobilized to Block 1100 of McCulloch Boulevard on the afternoon of May 28 in connection with the hit-and-run incident. Police said Ayers was driving on the island when he collided with another vehicle. Ayers drove away from the scene, and the victim followed him until he turned onto Beachcomber Boulevard. Police said the victim also took pictures of Ayers during or after the chase.
Officers found Ayers on Beachcomber Boulevard and talked to him. Police said Ayers was smoking when he first encountered law enforcement. Police said Ayers fell when he bent over to spit his cigarette on the ground. According to the report, Ayers spoke to officers while lying on his back.
Ayers is said to have said, “Just take me to jail.” Afterwards, he appeared to refuse an on-site sobriety test, saying: Just take me to jail ”
Ayers did not have a driver’s license while he spoke with officers, and police said he appeared visibly drunk at the scene.
Officers took Ayers into custody and put him in a waiting patrol car. Officers saw an open bottle of alcohol in the passenger seat of Ayers’ car, police said.
Ayers was transferred to the Lake Havasu City Jail, where officers obtained a warrant to take a blood sample from Ayers. The report said Ayers was speaking to officers without a lawyer present.
As of Monday, Ayers was not in custody.
