“As the debate over HB 619 and HB 1205 has played out in Concord and across the state, political rhetoric has muddied the discussion and distracted from two key factors every parent must consider: child safety and fairness,” the press release said. “These two factors have been my foremost consideration in considering these bills.”
House Bill 1205, also known as the “Fairness in Women's Sports Act,” is set to take effect on Aug. 19 and would require all sports teams in grades 5 through 12 to designate players by gender and would ban biological males who transition to female from participating in girls' sports.
This separation would mean that students would have the option to enroll in “boys, men, or boys,” “girls, women, or girls,” or “coeducational or mixed.” Students would be required to provide proof of their biological sex through a birth certificate, showing the sex “at or near the time of the student's birth.”
“HB 1205 will ensure fairness and safety in women's sports by maintaining a balance between athletic integrity and competition. With this broadly supported measure, New Hampshire joins nearly half of the states in the U.S. in passing this measure,” the press release stated.

House Bill 619 would prohibit health care providers from performing “genital sex reassignment surgery” on anyone under the age of 18. This includes procedures that create artificial genitalia, such as vaginoplasty, phalloplasty, and metoidectomy. Under the new law, these procedures would be considered “unprofessional conduct,” allowing minors and their parents to sue doctors who perform the procedures within two years of the procedure, and licensing boards could discipline doctors. according to To NHPR.
In a press release, Sununu's office commented on the Biden administration's opposition to the procedure on young people, citing the American Academy of Pediatrics and other countries, such as Sweden and France, that have “taken steps to impose a moratorium” on the procedure on minors.
The Biden administration reversed course on supporting younger people for surgery in June after Health and Human Services Under Secretary Rachel Levin faced backlash when she pressured the World Professional Association of Transgender Healthcare (WPATH) to remove age limits for surgery and hormone treatments for minors.
Sununu not only signed but vetoed both bills. HB396The bill would have allowed businesses and other government entities to discriminate on the basis of biological sex in restrooms, locker rooms, sporting events and other places, including prisons, psychiatric hospitals and treatment facilities.
