Greg Jarrett, a legal analyst at Fox News, said on Fox News’ “Honity” on Thursday that a “bright green light” to keep the US Supreme Court deporting illegal immigrants could affect the lawsuit of illegal immigrant Kilmer Armand Abrero Garcia.
The Supreme Court ruled in the Trump administration on Monday, allowing the continued illegal immigration to be deported to countries not designated by the removal order after lower courts attempted to block them. While discussing the potential release of Abrego Garcia by a federal judge, Fox’s Sean Hannity asked Jarrett where he could legally “go” since the illegal immigration case was brought back to the US after being deported.
“Well, for now, Garcia is in federal prison. Two different federal courts are fighting over what will happen next. Of course, like you said, he was charged with smuggling a human, allegedly abusing a woman, including a trafficking child,” Jarrett said. “Even so, the magistrate ordered him to be released. He said, ‘Yeah, he’s not a flight risk. He’s not a danger to the community.” ”
“Given the severity of the charges, the alleged connection with the murderous gangster MS-13, it’s an indictment and the fact that he was illegally here. “In the meantime, in Maryland, where Garcia’s wife lives, another judge is considering a request to move there, despite her having no jurisdiction.”
In March, the Trump administration deported Abrego Garcia to El Salvador, and Democrats later argued that illegal immigrants had not undergone proper “justified procedures.” The Department of Justice (DOJ) was returned to the United States on June 6 despite publishing related documents detailing Abrego Garcia’s relationship with MS-13 and other allegations including human trafficking. According to the DOJ, Abrego Garcia is facing criminal charges allegedly transporting illegal immigrants across the country, with Attorney General Pam Bondy accusing him of making more than 100 smuggling trips.
Since his return, his lawyers have asked the court to release him from prison. On Monday, US Magistrate Judge Barbara Holmes denied the DOJ’s request to detain Abrego Garcia prior to the trial.
“Add to that, we’re getting a kind of message. A DOJ spokesperson said, “Oh, we’re going to prosecute, we’re going to give Garcia a try.” But then the DOJ lawyer told the judge, “No, we’re moving forward to banish him when he’s released,” but he didn’t provide a timetable,” Jarrett said.
“But there’s certainly one thing. This week’s U.S. Supreme Court decision gives the Trump administration a bright green light to resume deporting immigrants to countries other than their own. I think it changed the Trump administration’s calculations. We have to move on.
In that case to the Supreme Court, the Trump administration alleged that the lower court’s orders hampered the ability to deport “some of the worst and worst illegal aliens,” adding that the United States is “at a crisis.”
