Judge Dismisses Trump’s Classified Documents Case Based On Jack Smith’s Unlawful Appointment

The judge overseeing former President Donald Trump's classified documents case on Monday granted a motion to dismiss the indictment.

Judge Eileen Cannon agreed to dismiss the lawsuit based on Trump's argument that the appointment of special counsel Jack Smith was unlawful, writing that Smith's appointment violated the Appointments Clause of the U.S. Constitution.

“Both the appointment and appropriations challenges contained in the motion raise a fundamental question: Is there any law in the United States Code that would authorize the appointment of Special Counsel Smith to conduct this prosecution?,” Cannon wrote. “After careful consideration of this important issue, the answer is no.”
