Republican U.S. Senators Katie Britt and Ted Cruz have introduced legislation aimed at protecting in vitro fertilization (IVF) following the Alabama Supreme Court's ruling earlier this year that fertilized embryos are considered children under state law.
Following the ruling, Alabama lawmakers and Gov. Kay Ivey passed a bill during the 2024 session that would protect IVF clinics from civil and criminal liability and allow them to continue operating.
Britt and Cruz are working together to introduce the IVF Protection Act to further protect IVF services across the United States.
“I am honored to introduce the IVF Protection Act with Senator Ted Cruz. IVF is pro-family, and I am proud to strongly support national access to this avenue to parenthood for the millions of American couples struggling with infertility,” said Senator Britt (R-Montgomery). “As a mother, I know firsthand that there is no greater blessing than a child, and IVF helps families across the country experience the joyous miracle of life, grow and thrive.”

The law does not compel any person or entity to provide IVF services. It allows states to enforce health and safety standards for the practice of IVF. States that ban access to IVF will be ineligible for Medicaid funding.

Britt and Cruz appeared on FOX this morning to discuss the bill.

“IVF has provided a miraculous hope for millions of Americans and given families across the country the gift of children,” said Sen. Ted Cruz (R-Texas). “I am proud to work with Sen. Katie Cruz. Britt “By ensuring that IVF is fully protected at the federal level, we will ensure that couples in Texas and across the nation have the opportunity to become loving parents.”

“My goal is to make Alabama a great place to live, work, believe and raise children,” Britt said. “After all, IVF helps create life and grow families and should be protected by law. I will continue to promote a culture of life while ensuring mothers and children have the opportunities and resources they need to achieve the American Dream and thrive.”
According to a survey conducted by the Pew Research Center, seven in ten Americans believe it's a good thing that people have access to IVF. The data also shows that roughly equal numbers of women (70%) and men (69%) are in favor of undergoing IVF.
