Kilmer Abrego Garcia, a Trump administration-sanctioned Maryland man, was accidentally deported to the infamous El Salvador prison and returned to the United States, and is scheduled to be arrested Friday in Nashville federal court.
The indictment of a major Tennessee ju trial issued May 21 and unsealed on Friday alleges that Abrego Garcia and an unknown co-conspirator were members of the MS-13 gang and “deliberately and illegally transported thousands of undocumented aliens” between 2016 and 2025.
The indictment filed in the Central District of Tennessee condemns Abrego Garcia “conspiracy to illegally transport illegal aliens” and “illegal transport of illegal aliens for financial interests.” The indictment has no suspected name or claim of the conspirator.
In another complaint filed Friday, prosecutors attempt to continue to custody Garcia, claiming he is a flight risk and risk to the community.

Prosecutors now argue that further investigations reveal a stop where Abrego Garcia illegally smuggles immigrants in the United States.
Rob McGuire, who has been the US attorney for the Central District of Tennessee since last year, and attorneys for the Joint Task Force, a unit specifically established to investigate MS-13 gang members, are listed in court records as prosecutors in the case.
