“You get a 6-foot-2-inch serial rapist, a serial child rapist with male genitalia, and he says, 'Hey, I want to be in a women's prison,'” Republican Sen. Ted Cruz of Texas said during a committee hearing on Netburn's judicial confirmation in May. “And your answer was, 'I think that's great.'”
According to the Beacon, McClain was convicted in 1994 of sexually abusing a 9-year-old boy and raping a 17-year-old girl. McClain was released in 2015, but was later convicted of distributing child pornography in 2017.

Federal prison officials opposed the transfer, but Netburn argued that concerns that the transfer “could be traumatic and dangerous” were “exaggerated,” The Beacon reported.
Pressed by Cruz during the committee hearing, Netburn referred to the male defendant as her “girlfriend” and said “everyone who is incarcerated has the right to feel safe in their own space.”
“Looking at your record, it's clear that your political ideology is far more important than the rights of the women you have endangered,” Cruz said during the committee hearing. “I believe you're an extremist. I don't believe you're fit to be a judge.”
