Jonathan Turley, a law professor at George Washington University, said Sunday that a Supreme Court judge was showing signs of “frustration” in a lower court over a deportation case.
The Supreme Court temporarily suspended the Trump administration’s efforts to use the 1798 alien enemy law to expel members of Venezuela prison gang Tren Aragua (TDA) early Saturday morning, saying detainees needed an opportunity to challenge their deportation. Tali said the High Court is being forced to take an “increasingly improvised” approach with the vast number of emergency situations. “What Judge Alito is opposed is that this is becoming increasingly improvised,” Turley told “Fox News Sunday” host Shannon Bream. “You’ve covered the Supreme Court for many years, as I have. We rarely go to this level of emergency before the Supreme Court, and many of them are half-baked in the sense that they are expressing their desires, in the sense that they simply don’t have the records you have.”

“Previously they expressed their dissatisfaction with the district court. In the case of Judge Boasberg, they said, “What is this doing in your court? This is a case of habeas corroboration that belongs to the South.” And I think they show some of that frustration,” Tarley told Bream. “And I think every political party should be aware of that. Going to the decision of the Fourth Circuit, the Trump administration should not alienate Secretary Roberts and others. They need to soften this language a bit.”
