The Supreme Court upheld Biden administration rules regulating “ghost guns” on Wednesday.
In 7-2 Arbitrationthe majority ruled that allowed gun parts kits to be regulated as traditional firearms was not inconsistent with the Gun Control Act (GCA).
“The GCA allows the ATF to regulate, so we will include some weapons part kits and unfinished frames or receivers, including unfinished frames or receivers,” Judge Niel Gauszcz wrote in the ruling. “The decision has been overturned because the Court of Appeals has ruled otherwise and the case will be remanded for further action that is consistent with this view.”
Justice Clarence Thomas and Samuel Alito opposed the ruling.
“The statutory conditions “frames” and “receiver” do not cover the unfinished frames and receivers contained in the weapon parts kit, and the weapon parts kit itself does not meet the legal definition of “firearms,” writes Thomas. “That should end the case. Instead, the majority congratulate the government on its overreach, based on a set of errors in both the review criteria and the interpretation of the law.”
