“You argue that oil and gas executives are not only sued, but also criminally charged – for murder, and for murder, based on climate change,” Cruz said. “is that so?”

Arkush said Cruz’s understanding was accurate, but he provided what he called his clarification.

“I take note of the language as murder is once again a technical term,” the witness said. “And definitely they don’t claim they could be charged with first-degree murder. It’s intentionally murdered.”

“Your position is, this is rational and reasonable. You should have people leading an American energy company and creating 8.5 million jobs. You have to arrest them and put them in prison,” Cruz said. “Is that correct?”

Arkush said certain energy executives may be facing such prosecutions.

“I’m going to say it and go to the record [that] It’s the quirky theory of Moonlight that you want to prosecute people who create jobs and create energy for murder,” Cruz said.

Cruz also introduced the law in May to protect the development of liquefied natural gas (LNG) against lawsuits that threaten the project.

The 2025 Protection Act prevents federal courts from nullifying previously approved LNG permits, send cases against LNG facilities to federal courts in the jurisdiction in which development is located, and imposes a 90-day window for legal challenges to the permit filed according to the bill’s text.
