WASHINGTON – A federal judge in New Hampshire on Monday blocked President Donald Trump’s executive order aimed at ending the constitutional rights of birthright.
His Interim injunction It was a third judicial lawsuit against an executive order signed by the president on his first day of his second term. Washington State and Maryland.
Judge Joseph N. Laplante said he would issue a statement on Tuesday regarding his reasoning, but noted that an injunction is necessary for “the status of a child born” as the lawsuit continues. Laplante was appointed in 2007 by former President George W. Bush.
The lawsuit brought by the American Civil Liberties Union argues that the executive order violates the US Constitution.
“The framers in Article 14 specifically set this principle in our constitutional text, and that even the President cannot deny children born in America in a rightful place as citizens. We cannot guarantee it.” According to the complaint. “They did so with the full knowledge and intention that this would protect immigrant children, including those facing discrimination and exclusion.”
Those who filed lawsuits against the Trump administration include organizations defending immigrant rights, with children having members who are denied citizenship under executive orders.
The Justice Department argued on behalf of the Trump administration that the phrase “subject to US jurisdiction” in the 14th Amendment is to be considered if parents are in or in a country without legal status, or if they are in a country. They claim that they will not expand to children if they are or to have them. They have temporary legal status such as visas.
“Previous infectious diseases in the Citizenship Clause created evil incentives for illegal immigrants that had a negative impact on the country’s sovereignty, national security and economic stability.” According to DOJ. “But the framers of the 14th Amendment did not fate the United States in that reality. Instead, texts, history, and precedents support what common sense enforces. The Constitution avoids immigration laws I don’t have a wind-defeated clause that grants American citizenship to the children of those who (or deny it).’
