A Lake Havasu man was due to go on trial this week for attempted second-degree murder, but has had to wait until November due to possible scheduling conflicts with another felony defendant.
Jason J. Fontes, 44, was scheduled to face trial in the Mojave High Court on Monday. But Mr. Fontes’ trial will continue until Nov. 13, according to Mojave County Deputy Attorney Paul Ammann. Instead of Fontes, Kingman resident Damien E. Robling, 41, will stand trial on felony charges of resisting arrest and aggravated assault.
Roebling was indicted in January 2022. He is also awaiting trial on separate charges of possession of dangerous drugs and possession of drug paraphernalia. Robling was convicted in 2014 of illicit sex with a minor in San Bernardino District Court, according to court records.
As of this week, Fontes is not being held on $60,000 bail and is expected to reside in the Prescott area pending a new trial date.
Prosecutors said Fontes got into an altercation with the victim on October 20 at a house on Block 1100 of Catalina Drive. Investigators said Fontes held a gun to the victim’s head during the altercation. Fontes allegedly fired at the moment the victim crouched under the muzzle.
The incident occurred while the victim’s 10-year-old son was hiding in his bedroom.
A police report said Fontes fled the scene of the shooting after the victim called an emergency dispatcher. Investigators contacted Fontes by text and phone after the incident to persuade him to turn himself in. Fontes was later found and taken into custody at a Solar Drive residence on October 22.
As of last year, Fontes’ previous arrest history included charges of aggravated harassment, disorderly conduct, trespassing, vandalism and domestic violence.
