Trial for Arizona rancher accused of shooting, killing migrant

SANTA CRUZ COUNTY, Ariz. (KGUN) — The trial of 75-year-old George Kelly Man accused of killing Mexican immigrant on his propertyIt starts at 9am on Friday.

Kelly is charged with second-degree murder and aggravated assault in the shooting death of 48-year-old Gabriel Kuyen Buitimea in Nogales, Mexico, early last year.

Kelly has always maintained his innocence,rejection Plea bargain Had he done so in January, his charge would have been reduced to one count of manslaughter.

His lawyers have argued that Kelly fired into the air above the migrants, but prosecutors dispute this, arguing instead that he fired into a group of men.

Lawyers for both sides are arguing over what evidence should be included in the trial.

The prosecutor November Appeals Court ruling This will allow Kelly's wife, Wanda, to be called to the stand.

It is not yet clear whether the text messages will be admitted as evidence.

The defense is seeking to call expert witnesses who will cast doubt on the investigation.

Kelly was released on bail until his trial, which begins again on March 21 and is expected to last three weeks.
