Sen. Tommy Tuberville spoke Thursday outside the main entrance to the Supreme Court, denouncing efforts by some Democratic states to remove former President Donald Trump from the ballot.
Joined by Sen. Roger Marshall (R-Kan.), Tuberville was inside the courtroom as the justices heard oral arguments on Colorado's decision to exclude Trump from the Republican presidential primary ballot. gave a speech.
“They are using a legal theory that has never been used before,” said Tuberville (R-Auburn). It goes far beyond the Constitution. It twists the language of our Constitution into something never seen before. ”
Colorado requires candidates because Section 3 of the 14th Amendment to the U.S. Constitution states that no U.S. official may hold any office if he or she has “engaged in rebellion or insurrection” against the federal government. They claim they have the right to exclude them from voting. Democrats claim that President Trump's actions on January 6, 2021 constituted an insurrection.

The senator said he doesn't think that argument is valid and that Democrats are hypocrites when it comes to protecting democracy.
“Democrats like to talk about democracy,” he claimed, “but they are desperately trying to prevent the American people from deciding who their next president will be. They don't care about our Constitution at all. They didn't care about the will of the people at all. They didn't care about our courts at all.”
Mr. Tuberville then asked the Supreme Court to halt the Democrats' illegal attempt to prevent Mr. Trump from running for president.
“This court must uphold the original public meaning of the Constitution,” he continued. “Stop this attack on our democracy today. Let the American people decide in November who will be their leader.”
