JUDGE ANDREW P. NAPOLITANO: Biden Tramples The Constitution With Another Aimless, Endless War

Can the president fight any war he wants? Can Congress fund wars of its own choosing? Are there any constitutional, legal, and moral requirements that must be met first before starting a war? Can the president and Congress fool the public?

These questions should be at the center of any debate over US involvement in Ukraine. what argument? The media is taking the CIA at its word, and only a few websites and podcasts (my own on You Tube) challenge the government’s reckless, immoral, illegal and unconstitutional war. Judging Freedom”).

All powers of the federal government derive from the Constitution and do not derive from any other source. But Congress has managed to extend its reach beyond the Constitution at home by spending money on areas it cannot regulate and by bribing states to buy compliance. Examples of this include minimum blood alcohol concentration numbers that trigger DWI arrests and maximum speed limits. In both cases, the legislature provided states with funds to pave the highways on the condition that both figures were lowered, and cash-strapped states accepted the funds with legislative strings. These are bribes from criminal consequences that Congress has waived.

The same thing happens in foreign policy. Congress cannot legally declare war on Russia because it has no military basis. Russia poses no threat to US national security. Moreover, the United States does not have a treaty with Ukraine that invokes U.S. military defense. But Congress is nevertheless spending money on the war in Ukraine.

Under the Constitution, only Congress can declare war. The last time it did so was to initiate America’s involvement in World War II. Congress, however, gave the president limited powers, allowing him to wage undeclared wars. An example of this is President George W. Bush’s criminal invasion of Afghanistan and Iraq, but has he discovered those weapons of mass destruction? — and the War Powers Resolution of 1973.

Not only is Congress not declaring war on Russia. The US military is not allowed to use it. But he gave President Joe Biden a blank check for $113 billion and allowed it to be spent on Ukrainian military equipment as needed.

He promised to continue to provide Ukraine with what it needs “as long as it is needed.” How much do you do? He cannot answer that question because he has no clear military goals. Removing Russian troops from Ukraine and Crimea, or removing Russian President Vladimir Putin as president, are not realistically achievable US military goals.

Congress has only authorized the shipment of arms and cash to Ukraine, but Mr. Biden has also sent troops. U.S. engagement in Vietnam began similarly. There was no declaration of war, but a gradual increase in US forces as advisers and leaders, followed by a congressional-backed war based on hoaxed reports of attacks on US ships in the Gulf. Half a million US soldiers were deployed in Tonkin, 10% of whom returned home in body bags.

We don’t know how many US troops are in Ukraine, but they don’t wear uniforms and their whereabouts are secret. We know they are involved in hostilities because much of the hardware Biden sent requires U.S. know-how to operate and maintain. And some of the weapons are actually being targeted and triggered by the US military against the Russian military.

Are American Soldiers Killing Russian Soldiers? yes. Neither had Congress’ approval, but Congress paid for them.

Now, let’s go back to the constitution. The War Powers Resolution, which authorizes limited presidential warfare but requires the president to notify Congress of any use of U.S. military force, constitutes Congress abandoning one of its core functions of declaring war. Therefore, it is unconstitutional. The Supreme Court has found that delegating core functions is unconstitutional.

Nonetheless, Biden has not communicated to Congress his intention to use the U.S. military violently. However, he used the navy and the CIA to attack Germany, which is a war crime and a violation of the NATO treaty. He also has uniformed soldiers stationed in Ukraine to perpetuate the deception that he doesn’t wear military boots.

Don’t be surprised if Biden informs Gang of Eight of the War Powers Act. what’s that? The Gang of Eight is a parliament within a parliament. It consists of the chairs and executives of the Intelligence Committees of the House and Senate, as well as Republican and Democratic leaders of the House and Senate who share secrets with the President. Just as Congress cannot delegate the power to wage war to the president, it cannot delegate the authority to wage war to the Eight. The Gang of Eight concept is antithetical to democratic values. Letting them know what kind of violence the president plans is done under an oath of secrecy. What kind of democracy would be secretly run and murdered?

Treaties to which the United States is a party limit the pursuit of war to what is necessary, defensible, and proportional. So, if a foreign power is going to attack, like 9/11, the president can strike first while the government is asleep. Beyond imminent attack, the grounds for war must be real, the enemy’s military threat must be grave and obvious, the purpose of war must be clear and achievable, and the means It must be commensurate with the threat.

Did Russia threaten the US? No. What serious deeds did the Russian military commit against the United States? What is Biden’s purpose? he won’t say

Will Congress support the Constitution? Will the President do? The answer is clear. We have left our constitutional security in the hands of disingenuous political hacks. The result is the death of innocent people, endless debt, and a massive loss of personal freedom.
