CNN senior legal analyst Ellie Honig said Tuesday that Fulton County District Attorney Fani Willis may have thrown out the election interference lawsuit against former President Donald Trump.
Mr. Willis appointed his girlfriend, Nathan Wade, as a special prosecutor in the case, which Mr. Trump's co-defendants claim is a conflict of interest because of the benefits they received based on their relationship with Mr. Willis. . Judge Scott McAfee will consider Thursday a motion to disbar Willis based on the allegations.
Honig told CNN's “Inside Politics” host Dana Bash that Willis and Wade could be removed from the case, potentially bringing it to an end. (Related article: Fani Willis seeks to quash subpoena for testimony)

“I think her problems continue to grow,” Honig asserted. “So the allegations made by several defendants, including Donald Trump, that there was a conflict of interest and that she had a personal romantic relationship with one of the outsiders brought in to prosecute this case. She has since acknowledged that this was the case and that there was a financial relationship that created a conflict of interest.”
According to bank statements included in the divorce filing, Wade bought plane tickets to Miami and San Francisco in Willis' name.
“There was a hearing yesterday, and on the Zoom hearing, we could see the prosecutor's office saying, 'Judge, this should be thrown out. We don't even need to have a hearing.' Well, the judge said, “I disagree.” There are some seriously debatable facts here. Therefore, a public hearing will be held on Thursday. “It's going to be very interesting to see, but it's going to be a very problematic case for prosecutors,'' Honig said.
He added, “This could effectively disqualify either the DA's office or Nathan Wade, or both, from this case, which would leave us wondering whether, if so, when and where. “This will cause even bigger problems,” he added.
