Alabama's Republican caucus is praising the efforts of Alabama Attorney General Steve Marshall in fighting President Biden's recent changes to Title IX rules.

Marshall filed a federal lawsuit on Monday challenging the Biden administration's proposal to change the meaning of “sex” under Title IX to “gender identity.”

Alabama Attorney General Steve Marshall filed the lawsuit on behalf of his state, and was joined by the states of Florida, Georgia and South Carolina.

Gov. Marshall and State Superintendent of Public Instruction Eric MacKee also issued a joint statement Tuesday advising schools not to implement any provisions in the new rules because they may violate existing state law.

“Yesterday, the state of Alabama filed a lawsuit challenging the U.S. Department of Education's recently issued Title IX rules,” the statement read. “Passed by Congress in 1972, Title IX prohibits discrimination on the basis of sex in any education program or activity receiving federal funding. The new rules seek to expand the meaning of 'sex' to include sexual orientation and gender identity. Compliance with the rules may violate relevant state law. At this time, Alabama public school districts should not take any steps to implement the new Title IX rules. Further guidance will be provided as the litigation proceeds and before the rules go into effect on August 1, 2024.”

Rep. Gary Palmer, R-Hoover, called the changes “unacceptable.”

“I am proud that Alabama stood up to Biden's disastrous Title IX reforms,” ​​Palmer said. “Far from protecting women, this administration is trying to use Title IX to advance an extreme political agenda. This is unacceptable. We will not tolerate this.”

Rep. Jerry Carl (R-Mobile) said he was “proud” of his state fighting attacks on women's sports.

“Congress enacted Title IX to protect women, but Biden has chosen to rewrite Title IX to protect men who identify as women,” Kahl said. “There is no room for men in women's sports, and I am proud to represent a state that will always stand up to protect women and girls in sports.”

Rep. Barry Moore (R-Enterprise) called the rule change “a disgrace.”

Sen. Tommy Tuberville, R-Auburn, argued that this just proves Biden has “ruined our education system.”
