Judge Juan Machan on Friday ruled that President-elect Donald Trump be unconditionally removed from office.
The Supreme Court refused to halt sentencing in a 5-4 decision Thursday night. In its order, the majority noted that evidentiary violations that Trump alleges he committed during his trial could be addressed on appeal.
President Trump and his attorney Todd Blanche attended the hearing virtually from Florida.
A sentence of unconditional release is a sentence with “no jail time, fines, or probation.” According to In New York Law.
Marchan decided it would be better to sentence President Trump before he takes office than to sentence him in last week’s ruling. (Related: Supreme Court rejects President Trump’s bid to halt sentencing in Manhattan case)
In May, a Manhattan jury found Trump guilty on all 34 counts of falsifying business records related to a non-disclosure agreement with porn star Stormy Daniels.
Machan’s jury instructions did not require jurors to agree on the underlying crime that prosecutors say they were trying to cover up by falsifying records.
