“There are right ways and wrong ways to use artificial intelligence, and we have to approach it with caution,” said Gates.

She shared examples of how AI can be beneficial, such as helping defendants navigate complicated processes like divorce. Gates also mentioned that AI could enhance the efficiency of judicial tasks.

For example, a secure AI tool could swiftly analyze numerous documents to uncover specific details—something basic search tools might struggle with, like tracking how often a party tests positive for drugs.

Nevertheless, there are valid concerns, especially regarding evidence created by AI. Gates pointed out challenges judges face when experts can’t adequately explain how AI-generated outputs, like accident reconstruction videos, were produced.

“For instance, litigators might present a reconstruction video of an accident,” she explained. “If the experts can’t specify how the AI tools created that video, it poses a significant challenge for judges to assess.”
