Attorney Alan Dershowitz said on Newsmax that Central Park Five might come to regret filing an honor loss lawsuit against President Donald Trump, calling both legally tenuous and politically risky cases for plaintiffs.
Federal judge I refused Dismisses a honour-loss lawsuit filed by the exonerated Central Park Five against Trump for his past disclosure. Appearing in “The Records of Greta Van Susterlen,” Dershowitz said the five men in Central Park were not completely innocent, and the new scrutiny could rather publish details that will continue to be buried.
“This would be a very difficult case for plaintiffs to win. They weren’t innocent people. They were doing things they didn’t deserve to be praised in the park. At least some of them were.” “They didn’t acknowledge their guilt. But it’s a much more complicated and subtle case. And I think they’ll regret bringing it because when this case actually goes to trial, they get a deposition that shows exactly what they did and where they were.”
As some of the plaintiffs are pursuing political careers, Dershowitz warned that the incident could reveal an unpleasant truth.
clock:
“These are people who have political ambitions now. They are in office. They present themselves as the most amazing people on the surface of the earth. They weren’t. And the more you dig up this case, the more you’ll see this as a case of grey territory,” Dershowitz said. “And if they are public people, the big problem would be if the plaintiffs were public figures and they had to demonstrate that they were not only falsely accused, but they were mistakenly accused of recklessly ignoring the truth, that’s not so easy.”
Dershowitz said the case might be resolved in the end, but he also said a full trial could be useful in the public interest. (Related: Alan Darshaw breaks down how Trump secured a “partial victory” in the Scotts deportation case)
“My feelings are probably that the case will eventually be resolved, but the public will be useful by actually litigating the case and seeing the real dynamics of that horrifying and terrifying night when the innocent woman was almost killed while jogging in Central Park,” Dershowitz said.
Dershowitz added that the lawsuit falls on plaintiffs.
“They also have another problem. He said the same thing a few years ago. They were damaged by his page ads in the New York Times a few years ago, and they must show that it is a repetition of the damages they are discussing. “Trump had the right to seek the death penalty return. He had the right to use this case. Now you know, The New York Times and Sullivan have established the principle that you don’t need to name people specifically in order to commit a crime.
The lawsuit highlights Trump’s long-term feud with Central Park Five, who was falsely convicted of 1989’s investment banker Trisha Meiri after being attacked while jogging in the evening. The attack was so serious that doctors feared she would survive, and first began treating the case with prosecutors as a potential murder.
Five men filed a honour-loss lawsuit against Trump in October, accusing him of mistakenly linking it to a 1989 crime. They cited Trump’s comments during his September 10 debate with Vice President Kamala Harris, where she also nurtured their past calls.
