Olson Real Estate Group Inc. and 115 Schnebly LLC filed the lawsuit in Yavapai County Superior Court on Thursday, July 24, against 15 defendants, including the city of Sedona.
Sedona Mayor Scott Jabrow, Vice Mayor Holly Ploog, City Council Member Melissa Dunn, City Council Member Brian Fultz, City Council Member Pete Furman, City Council Member Cathy Kinsella and City Council Member Jessica Williamson are each listed as individual defendants.
The corporation, 115 Schnebly LLC, is 100% owned by RD Olson Investments II LLC. The RD Olson Group plans to build Oak Creek Heritage Lodge at 115 Schnebly Hill Road, whose development review was unanimously approved April 16 by the City of Sedona Planning and Zoning Commission.
On June 25, the four candidates, Fultz, Dunn, Ploog, and Jabrow, won the majority. The Sedona City Council has overturned and revoked the P&Z Commission's unanimous approval of the development review.
Carol Breen, Nancy Friedman, Shawn Smith, Mark tenBroek, Ann Kelly, Lauren Thomas and Christine Wagner have appealed the development plans twice and are also listed as defendants in the lawsuit.*
As of this writing, Yavapai County Superior Court has issued summonses for the defendants.
