California Lawmaker Files Lawsuit Over Redistricting

A Republican lawmaker from California has initiated a lawsuit in the state Supreme Court, urging Democrats to advance their plans to redraw the legislative map.

Four GOP lawmakers submitted an emergency petition to the California Supreme Court, arguing that the Democrats’ proposed plan is “unconstitutional.” They claim it aims to push through the redistricting process without proper oversight. A vote on a new legislative district map is expected during the special election scheduled for November 4.

This lawsuit is part of an escalating nationwide conflict over constituency boundaries, which began with Texas Republicans during the mid-terms. The new map is projected to create five additional Republican seats. In response, California’s Democrat Governor Gavin Newsom has proposed his own plan to counteract the changes initiated by Texas Republicans.

Newsom’s initiative to redraw California’s map involves transferring the zoning authority from an independent commission to the state legislature, which would require a statewide referendum.

A Republican representative, supported by Dillon Law Group, contends that the Democrats’ actions breach the state’s constitutional obligation for a 30-day public review period for any new laws. Allegedly, they have utilized a strategy known as “guts and amendments” to modify unrelated bills and insert rezoning language, thus bypassing this requirement.

Instead of a transparent, month-long process managed by an independent commission, the lawsuit claims that a simple vote will replace proper oversight.

The lawmakers are requesting that the California Supreme Court pause the bill’s activities until September 18 to honor the review period. The National Republican Congressional Committee has voiced readiness to challenge Newsom’s attempts to gain what they consider unlawful power in court and at the ballot box.

In a response, Brandon Richards from Newsm commented on the situation: “We are not surprised and not worried about Republicans filing what seem to be absurd lawsuits to hinder voting.”

No matter how the court rules, California’s Democrats might still face significant challenges ahead. Recent polls indicate that Californians favor independent commissions by nearly a two-to-one margin for determining congressional boundaries.
