CNN host John Berman fact-checked Michigan Democratic Gov. Gretchen Whitmer on Monday after she claimed former President Donald Trump was paving the way for a federal abortion ban.
Trump has said states should set their own abortion laws, not the federal government. Governor Whitmer told CNN News Central that Trump is “absolutely responsible” for the Supreme Court's 2022 overturning of Roe v. Wade, leading the country toward a federal abortion ban. “He appointed three Supreme Court justices who lied to Congress,” Whitmer said. “They said Roe was the law of the land. They betrayed the oath they took when they got into office. Without Donald Trump, we wouldn't be in this situation today. He appointed these justices to the Supreme Court. It doesn't matter that he's taken 18 different positions over the years. He's been a front-line activist for a total, nationwide abortion ban. That's why we must elect Joe Biden this fall.”
“He's said he's not going to a total federal ban on abortion because he wants to leave that up to the states. He's said he doesn't support a federal ban,” Berman said. “I'm not disputing that he's responsible for overturning Roe v. Wade, but in that particular position, he's saying he wants to leave it up to the states.”

“My view … is that each state should decide, either by legislation or by voting or both, and that decision should become the law of the land. In this case, it's state law. It's going to be different in some states, many states have different numbers of weeks, some states are more conservative than others, but that's the reality. At the end of the day, this is all about the will of the people,” Trump said when announcing his stance on abortion in April. “You have to follow your heart, or in many cases your religion or your beliefs. Do what's right for your family, what's right for you … do what's right for your country.”
