Senate Republicans will reintroduce the bill Thursday to impose criminal penalties on individuals who leak sensitive information related to the U.S. Supreme Court.
Louisiana Republican Sen. Bill Cassidy, Tennessee’s Marsha Blackburn, and Mississippi’s Cindy Hyde Smith. Supreme Court’s leakage laws will be suspended. The law requires that individuals who leak information from the Supreme Court pay a $10,000 fine and serve in prison for up to 10 years, according to a text from the bill obtained by the Daily Carrera News Foundation. The bill also requires that leakers seize any profits they may obtain from disclosing confidential information. The Supreme Court has been shaken by several prominent cases of leaks that make internal judicial deliberations available to the public.
“A Supreme Court leakage must be a criminal offence. A leakage threatens the safety of justice, damages the reputation of the court and puts life at risk,” Cassidy told DCNF. “They have to be accountable, not praised.”

Private memos and other court documents that appear to be linked to three major cases involving President Donald Trump have been leaked to the New York Times Report Released in September 2024.
A longtime court observer previously told the DCNF that a high-level member of the court’s liberal minority was likely responsible for the leak.

“The Suspension Supreme Court’s Leakage Act is a critical law and will ensure that court work is free from unnecessary external interference by cracking down on those who leak confidential information,” Blackburn told DCNF.
The unprecedented leak over the past few years “just undermine public trusts and the Supreme Court as an institution,” Hyde Smith said.
Previous versions of Cassidy’s bill failed to advance in the then democratic Senate.
