Alabama Republican Sen. Katie Britt on Tuesday asked Attorney General Merrick Garland to preserve records regarding the Department of Justice’s (DOJ) response to abortion activists protesting in front of the Supreme Court justice’s home.
Garland accused the Justice Department of “failure to enforce federal law” and protesters who picketed outside the judge’s home for months after the Dobbs v. Jackson Women’s Health Organization decision was leaked in 2022. For almost two years, the government has not provided any answers regarding the crackdown on these crimes. It also led to an attack on a pro-life pregnancy center and an assassination attempt on Judge Brett Kavanaugh, Britt wrote in Tuesday’s letter. “The preservation of these records is important as I continue to work with the incoming administration to monitor and investigate this matter during the 119th Congress,” Britt told Garland in the letter.
Britt pressed Garland during a March 2023 hearing about a training slide instructing federal marshals not to arrest protesters outside a judge’s home. Garland previously testified that the sheriff had full authority to make arrest decisions, but said he had not seen the slides.
The Justice Department also did not respond to Britt’s follow-up request in a May 2023 letter, according to the letter.

“Despite repeated communications from my office regarding the status of the response, I did not receive a response until I raised this issue again at a hearing of the Commerce, Judiciary, Science, and Related Agencies Appropriations Subcommittee in April 2024. ‘s letter was ignored for nearly a year,” Britt wrote in Tuesday’s letter. “A few days after that hearing, I finally received a response from the Department of Justice after almost a year’s delay, but that response made no attempt to respond to any of the questions or requests I raised in my original letter.”

Britt asked Garland to preserve all “draft copies of training materials, guidance, mail orders, or other documents” related to the Department of Justice’s enforcement of federal law that have been reviewed by the Attorney General’s Office. She also asked Garland to preserve records of emails and communications from his office related to enforcement of the law.
The Justice Department did not immediately respond to a request for comment.
