Former DOJ Official Says It’s ‘Hard’ To Imagine Another Georgia DA Taking Up Fani Willis’ ‘Flawed’ Trump Case

Former George W. Bush Justice Department official John Yoo said Thursday that another Georgia district attorney (DA) could take over the case against President-elect Donald Trump following the disqualification of Fulton County District Attorney Fani Willis. He said that the gender is low.

The Georgia Court of Appeals on Thursday disbarred Willis, citing “appearances of fraud,” and said the step was necessary “to restore public confidence in the integrity of the proceeding.” On “America’s Newsroom,” Yoo said it was undesirable for Georgia’s replacement prosecutors to pursue Trump on RICO charges, and the case would likely be stayed or dismissed. He suggested that it would be possible. (Related: CNN’s Elie Honig says proposal to delay Trump’s sentencing until after he takes office is ‘ridiculous’)

“Dana, this is another example of this legal movement carried out by the Democratic Party that boomerangs back to the Democratic Party and lands on their ears. Anyone who watched this trial remembers this. “I hope this is the same prosecutor who claimed that the entire Trump re-election campaign was like an organized crime racket designed to disenfranchise all citizens,” Yoo said. “But this summer we saw dramatic testimony that prosecutor Fani Willis hired her boyfriend to effectively serve as a special prosecutor, overpaid her, and then led her to investigate and indict Donald Trump. Please remember what you did.”

“That’s a complete conflict of interest. If you take a quick look at the Georgia Court of Appeals decision here, it says so. It seems so inappropriate and it seems like it’s a conflict of interest that Fani Willis should not be a prosecutor,” he continued. “I think this means yet another case that will likely be put on hold or simply closed and thrown out. Another Georgia district attorney will take up this flawed case, and Trump’s I have a hard time seeing anyone trying to prosecute Mr. Trump on the theory that his re-election campaign was some kind of organized crime enterprise.”

A grand jury indicted Trump and 18 others in August 2023 on charges of violating the RICO Act for allegedly trying to overturn the results of the 2020 state election.

After several days of evidentiary hearings in March, Judge Scott McAfee found that Willis’ relationship with Nathan Wade, whom he appointed as special counsel in the case against Trump, created “an appearance of gross impropriety.” did. The judge allowed Willis to continue the case if Wade recused himself from the case.

Mr. Trump’s co-defendant, Michael Roman, originally filed a motion in January to clarify the relationship between Mr. Willis and Mr. Wade. The motion accused Willis of using the money he earned from his position to sign lucrative contracts and benefit financially when they vacationed together.
