‘Important First Step’: Lawmakers Roll Out Major Permitting Bill To ‘Unshackle’ American Energy

Wyoming Sen. John Barrasso, a Republican, and West Virginia Sen. Joe Manchin, an independent, introduced a bipartisan permit reform bill on Monday after months of negotiations.

Specifically, the bill would expedite leasing and permitting for energy projects on federal lands, set deadlines for processing coal lease applications, and eliminate duplicative permitting requirements for drilling off federal lands. The bill also requires the federal government to hold at least one offshore wind and offshore oil lease each year from 2024 through 2029, streamlines the construction process for new electric transmission projects, and requires the Federal Energy Regulatory Commission to consider impacts to electric grid reliability when evaluating federal regulations.

The Biden administration is currently moving forward with the most stringent offshore oil and gas leasing plan in modern U.S. history, spanning 2024 to 2029. The senators also included a condemnation of the Biden administration's decision in January to impose a moratorium on liquefied natural gas (LNG) export terminals. The bill would effectively end that moratorium by requiring the Secretary of Energy to issue approval or denial of related permits within 90 days of the completion of an environmental review.

Permitting reform has become a hot topic on the political agenda in recent years, with Republicans seeking to eliminate red tape and regulations that slow the development of fossil fuel infrastructure like pipelines, while some Democrats have come to believe that major permitting reform would benefit new projects and green energy initiatives for the future that require the massive buildout of transmission infrastructure.
