Jonathan Turley Says He’s ‘Confused’ Why Amy Coney Barrett Joined Liberal Justices In SCOTUS’ Deportation Ruling

Jonathan Turley, a law professor at George Washington University, expressed confusion Tuesday about why Supreme Court assistant judge Amy Connie Barrett opposed a ruling that allowed President Donald Trump to use the 1798 law to expel gang members.

The Supreme Court ruled late Monday that the Trump administration could use alien enemy laws to send members of Venezuelan prison gangster Tren DeLagua (TDA) in a 5-4 ruling. Tarly questioned why Barrett joined the deputy judges of Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson in opposition to the majority opinion. “The objection is a bit strange here. These four justices, especially Judge Barrett. [I] I still don’t know why Barrett joined the other way, which I wrote on my blog this morning,” Tarley said. “She joined in part, some of them said they would get the right to a legitimate process, but the majority said so. So, I’m still quite confused as to why Justice Barrett opposed it.”

“There are all reasons to question the rushing conclusions of the majority that habeasants provide an exclusive means of challenge to alien law-based removal,” Sotomayor wrote to some of the opponents Barrett joined.

Supreme Court Justice John Roberts also suspends US District Judge Paula Sinis’ Friday’s order, demanding that the Trump administration return Abrego Garcia, an arbitrary member of El Salvadra prison gang MS-13, to the United States.
