Federal Judge Rules on Free Speech Rights for Non-Citizens

A federal judge has issued a ruling regarding the Trump administration’s actions toward foreign nationals protesting in the U.S. The administration has been attempting to curb often violent anti-Israel protests that have emerged on city streets and university campuses following the deadly attacks on Israel on October 7, 2023. Judge William Young, appointed by Reagan, stressed that legally residing non-citizens possess the same freedom of speech rights as U.S. citizens.

“This lawsuit—perhaps one of the most significant cases within this district court’s jurisdiction—aims to clarify if non-citizens who are legally present in the U.S. have the same freedom of speech rights,” the ruling states. “The court unequivocally affirms that the answer to this constitutional question is yes.”

Officials, including Secretary of State Marco Rubio, named as a defendant in the case, had contended that foreign nationals, especially those on student visas, might face deportation for their speech. This concern particularly arises if they openly support foreign terrorist organizations or violate laws during protests.

The lawsuit was initiated by groups such as the American Association of University Professors (AAUP), the American Federation of Teachers (AFT), and the Middle East Studies Association.

Judge Young stated, “After thoroughly reviewing the entire record, the court retains the right to oversee how the actions of the relevant divisions are coordinated, with compelling evidence concerning Secretary of Homeland Security Christa Noem and Secretary of State Marco Rubio, along with their respective officials and agents. The next step involves addressing the remedies for these constitutional violations.”

Amid allegations of anti-Semitism, the administration has revoked over 1,000 student visas, citing Palestinian involvement in protests that sometimes seem to endorse Hamas. Some deportation cases have sparked significant criticism and legal challenges, raising questions about the administration’s justification and approach.
