The judge in President-elect Donald Trump’s hush-money case has accused Trump’s legal team, an incoming Justice Department official, of undermining the justice system by sentencing him before he took office.
New York State Supreme Court Justice Juan Marchan accused Trump’s legal team of making “dangerous statements” in questioning the constitutionality and legality of the lawsuit. According to Until the verdict. Mr. Trump’s legal team includes Todd Blanche, a candidate for deputy attorney general, and Emil Bove, his chief of staff who will be appointed deputy attorney general.
President Trump nominated Mr. Branch and Mr. Bove to their posts on November 14th.
“But now lawyers are relying on language, in fact, rhetoric, that has no place in legal argument…” Marchand wrote in the decision. “Considering the totality of the circumstances and bearing in mind the parties to this action, discussions such as this could, in the grand scheme of things, create a chilling effect on the third sector of government.”(Related article: Sentencing order for President Trump before Inauguration Day)

In May, after a weeks-long trial, a Manhattan jury convicted Trump on 34 felony counts of falsifying business records related to his non-disclosure agreement with porn actress Stormy Daniels. According to the ruling, Marchan ordered Trump to appear in court on January 10, saying there was “no legal impediment” to sentencing him and that it would be “less desirable” to impose a sentence after taking office.
According to the ruling, Marchan also does not intend to give Trump a prison term.
Sentencing was originally scheduled to take place before the Republican National Convention in July, but was postponed multiple times. The first delay was in response to the U.S. Supreme Court’s ruling on presidential immunity that same month. Sentencing was postponed indefinitely after Trump won the presidential election in November.
White House communications director nominee Stephen Chan addressed the issue in a statement.
“Today’s order by acting Judge Marchan, a deeply conflicted judge in the Manhattan witch hunt case, is a direct violation of the Supreme Court’s immunity decision and other longstanding precedent,” Chan said. “This lawless lawsuit should never have been filed, and the Constitution requires it to be dismissed immediately. He must be allowed to continue and carry out his important presidential duties. There should be no sentencing, and President Trump will continue to fight the hoax until it is all dead.”
