PHOENIX — A federal jury this week convicted a 42-year-old man from Guatemala on two charges of assaulting a federal employee.
According to a press release issued by the Arizona Federal Attorney’s Office, Jorge Oliverio Moran Cann was found guilty of one count of assault on a federal employee.
A verdict is scheduled for July 6.
On July 3, 2022, U.S. Border Patrol agents responded to a remote area near Newfield in Pima County, located along the Arizona-Mexico border.
Agents were chasing three undocumented and suspected non-citizens in a mountainous area. When the agent approached the group, two of her fled on foot.
According to the release, Moran-Can did not escape. However, when the agent tried to handcuff him, Moran-Can slammed his shoulder into the agent’s torso and they both tumbled down the rocky slope.
Agents, who had cut and bruised his left knee during the fall, eventually handcuffed Morankan.
Conviction for assault on federal employee – bodily injury carries a maximum penalty of 20 years in prison, a maximum fine of $250,000, or both.
Conviction for assault on a federal employee – physical contact carries a maximum penalty of 8 years in prison, a maximum fine of $250,000, or both.
