The Maricopa County Attorney’s Office announced that 68 pro-Palestinian protesters arrested at Arizona State University’s Tempe campus several months ago have been charged with trespassing.
A statement from the top prosecutor said university policy prohibits encampment on the lawn near Old Main, where protesters defied police orders to leave.
In May, a judge dismissed more than 70 trespassing charges against people arrested during the previous month’s protests.
Lawyers like Rey Ybarra Maldonado asked the court for a permanent dismissal, but the judge said no.
Most prosecutors have now been reinstated.
“And continuing to make accusations like this is a complete waste of government resources and a slap in the face to everyone who cares about human rights,” Ibarra Maldonado said.
The county attorney’s office said ASU police initially issued citations to those arrested, but needed to make a quick decision on whether to file charges.
ASU police then resubmitted the case at length to give prosecutors enough time to consider the large amount of evidence.
Ybarra-Maldonado said those arrested were exercising their First Amendment rights.
“This wasn’t a camping activity. People weren’t going out there to have barbecues and drink beer. This was a protest,” Ibarra Maldonado said.
