
Yavapai County Attorney Dennis McGlund announced on June 10, 2025 that Bin Puong Nguyen, 31, of Oklahoma City, was sentenced to guilty of perjury. Nguyen was convicted of perjury on May 21, 2025 by a ju judge in Yabapai County. County Attorney McGrand praised his partners to the Drug Trafficking Task Force and the Yavapai County Sheriff’s Office and thanked the judges for their attention to the facts. McGlenn also praised prosecutor Matthew Polk for his struggle to prepare a case for the trial.
Nuguen was declared by the honorable Debra R. Phelan of Yabapai County Superior Court. Nguyen faced a prison range of 2.25 to 6 years, and the court had the discretion to order sentences simultaneously or consecutively as the four years Nguyen has already served. Judge Phelan sentenced Nguyen to a 25-year mitigation term at the Arizona Department of Corrections, where Judge Phelan ordered Nguyen to run at the same time as Nguyen’s former sentence.
County Attorney Dennis McGrand said, “I consider perjury a humiliation to our criminal justice system. It should be treated with the utmost seriousness, and punished accordingly, and the punishment will be adapted.”
The lawsuit began on June 20, 2023 when the Yavapai County Sheriff’s Office’s deputy with a partner to the Drug Trafficking Task Force attracted a vehicle driven by Nuguen due to a routine traffic violation outside of Ashfork, Arizona. Registered owner of the car, Vinh Duong, 32, of Edmond, Oklahoma, was in the front seat. In the back seat was Nguyen’s 8-year-old son and Duong’s 7-year-old son. Deputies eventually searched the car and found a kilogram of cocaine, 1,000 counterfeit Adderall pills containing methamphetamine, and a gun in the trunk of the vehicle. Further investigation revealed that Duong and Nguyen, along with their children, bought 23 hours from Oklahoma City, Oklahoma to San Jose, California for $16,000. They then turned and drove back to Oklahoma City before eventually halting at Ashfork.

Nguyen pleaded guilty to a human trafficking case in accordance with the November 7, 2023 plea agreement, attempts to sell or transport drugs, child abuse, weapons (possession of weapons during a drug crime), and possession of a paramedicinal drug. Nguyen was sentenced to four years in Arizona State Jail on December 4, 2023.
Duon was brought to trial in a ju trial from July 31, 2024. During the trial, Nguyen testified that Duong was simply together for a father’s day holiday with his son and not part of the drug deal. The ju umpire failed to reach a unanimous verdict on Duon’s guilt, and a erroneous statement was declared based on the umpire.
Prior to the retrial, analysis of Nguyen and Duong’s mobile phones found additional innocent evidence indicating that Duong is an actual drug buyer. Duon was tried for the second time and was found guilty by a ju judge on November 1, 2024. Duon was sentenced to seven calendar years in Arizona State Prison.
Then, on May 21, 2025, in another trial, Nguyen was found guilty of perjury for making a false statement of oath under oath at Duong’s first trial.
Under the Arizona truth in the sentencing law, Nguyen was already eligible for early release on November 24, 2026, to try or take good action on the sale or transport of drug drugs. Those same laws allow Nguyen to qualify for early release to get good action for the new Perjury conviction on November 10, 2026.
