Pro-Gun Group Secures Big Win Over ATF In Federal Court

A federal judge on Tuesday struck down a ban on reset triggers imposed by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).

The court's ruling stated that the ATF “engaged in unlawful agency activity that exceeded its authority,” and emphasized that it did so by “redefining the statutory definition” of a “machine gun.”

The judge argued that the FRT did not meet the statutory definition of a machine gun because a firearm equipped with the device “must be reset after firing each round and must have a separate mechanism to move the hammer sufficiently rearward to release the hammer to fire the next round.”

“For years, the Biden/Harris administration has been forcing gun control legislation on the ATF after failing to pass gun control legislation in Congress,” Hannah Hill, executive director of the National Gun Rights Foundation, told The Daily Caller. “This ruling draws a line under the wall to prevent the ATF from expanding its powers.”

“With this ruling and the Supreme Court's Cargill decision, gun control has become significantly more difficult for an anti-gun president, as the ATF has been systematically reined in by the judicial system and forced to return to constitutional bounds,” Hill added.
